Normy prawne regulujące działania antyterrorystyczne

Abstract

Terroryzm, stanowiący współcześnie jedno z najpoważniejszych zagrożeń dla bezpieczeństwa narodowego, angażuje wiele różnych organów i instytucji państwowych. Skuteczność w zwalczaniu zdarzeń o charakterze terrorystycznym w dużej mierze zależy od skoordynowania działań tych podmiotów. Zwiększenie uprawnień organów państwowych w tym zakresie nie może jednak powodować nieproporcjonalnego wzrostu ograniczeń w korzystaniu przez obywateli z przysługujących im wolności i praw. Obowiązująca ustawa antyterrorystyczna (ale również szereg ustaw z nią powiązanych) niesie za sobą taką możliwość, a w konsekwencji nie zwiększa poczucia bezpieczeństwa obywateli i ich zaufania do własnego państwa. W artykule podjęto próbę analizy przyjętych rozwiązań i wskazano regulacje budzące najwięcej wątpliwości.

Terrorism, which today constitutes one of the most serious threats to national security, engages many different state bodies and institutions. Effectiveness in the fight against acts of terrorism is largely dependent on the coordination of these factors. Increasing the powers of state bodies in this respect cannot cause a disproportionate increase in restrictions of citizens’ enjoyment of their freedoms and rights. The current anti-terrorism law, as well as a number of related laws doesn’t provide such guarantees and consequently doesn’t increase citizens’ sense of security towards their own state. The article attempts to analyze the adopted solutions and points to the most questionable regulations.
