Abstrakt
Nieprzydatność w warunkach okupacji wojskowego oraz cywilnego sądownictwa II Rzeczypospolitej spowodowała, że Polskie Państwo Podziemne musiało rozpocząć budowę wymiaru sprawiedliwości od podstaw. Żołnierze oraz osoby, które popełniły przestępstwa w szeregach organizacji wojskowej podlegali właściwości nowo utworzonych wojskowych sądów specjalnych. Dla ukarania osób cywilnych, które popełniły, wymagające natychmiastowej reakcji, ciężkie przestępstwa przeciwko interesom państwa polskiego, narodu i obywateli, utworzono cywilne sądy specjalne. Podziemny wymiar sprawiedliwości uzupełniały komisje sądzące, których celem było wychowawcze oddziaływanie na społeczeństwo w duchu utrwalania postaw patriotycznych, obywatelskich i moralnych. Podziemny proces karny podporządkowany był konieczności zachowania pełnej konspiracji. Maksymalnie uproszczono procedury, drastycznie zredukowano gwarancje procesowe oskarżonego, który nie miał możliwości usłyszenia zarzuconych mu czynów, zgłaszania wniosków dowodowych czy korzystania z pomocy obrońcy. Jednocześnie, na ile to było możliwe, duży nacisk kładziono na postępowanie dowodowe i fachowość sędziów. Sądy specjalne składały się z ludzi o wysokich kwalifikacjach, którzy starali się, aby wszelkie dane o oskarżonym opierały się na wiarygodnych, maksymalnie sprawdzonych źródłach informacji. Publikowane wyroki przekonywały społeczeństwo, że prawo i kodeks moralności obywatelskiej nadal obowiązuje, a Polskie Państwo Podziemne realizuje funkcje również w zakresie sądownictwa.
The failure to meet the objectives by the civil and military arms of the judiciary of the Second Republic of Poland under wartime occupation made the Polish Underground State start the construction of the judiciary from a scratch. Soldiers and civilians who committed crimes in military organisations were in the jurisdiction of the newly established special military courts. To punish the civilians who committed heavy crimes against the interests of the Polish state, nation, and citizens that required immediate reaction, special civil courts were established. The clandestine judiciary was complemented with judging commissions whose goal was to provide an educational impact on the society in the spirit of reinforcing patriotic, civic, and moral stances. The underground criminal trial was subordinated to the need of preserving maximum conspiracy. Procedures were simplified as far as was possible, and the process guarantees of the accused were drastically reduced, as the accused had no opportunity to become familiar with the charges, submit evidence, or use legal support. At the same time, as far as possible, emphasis was laid on evidence-based investigation and expertise of the judges. Special courts were composed of people with high qualifications, who made sure that all the data about the accused were based on credible sources of information proven to the maximum extent. The published sentences proved to the society that law and the code of civic morality still bind, and the Polish Underground State carries its functions also in the area of the judiciary.
Die Unbrauchbarkeit des militärischen und zivilen Gerichtswesens der 2. Republik Polen in den Umständen der Besatzung führte dazu, dass der Polnische Untergrundstaat seine Justiz ganz neu aufbauen musste. Die Soldaten und andere Personen, die Straftaten auf dem Gebiet der Militärorganisation begangen hatten, unterlagen der Zuständigkeit neu gegründeter Militärsondergerichte. Zur Bestrafung von Privatpersonen, die schwere Verbrechen gegen die Interessen des polnischen Staates, des Volkes und der Bürger begangen hatten, die einer sofortigen Reaktion bedürften, wurden Zivilsondergerichte eingerichtet. Das Gerichtswesen im Untergrund wurde auch von Schiedskommissionen ergänzt, deren Aufgabe war, eine erzieherische Einwirkung auf die Gesellschaft auszuüben, indem die patriotischen, bürgerlichen und moralischen Haltungen gestärkt werden sollten. Das Strafverfahren im Untergrund wurde den nötigen Regeln voller Konspiration angepasst. Das Verfahren wurde wesentlich vereinfacht, die Verfahrensgarantien des Beschuldigten wurden drastisch begrenzt, indem er keine Möglichkeit hatte, die ihm gestellten Vorwürfe zu hören, die Beweisanträge zu stellen oder einen Verteidiger beizuziehen. Gleichzeitig aber, soweit dies möglich war, wurde ein großer Druck auf das Beweisverfahren sowie die Fachkompetenzen der Richter gelegt. Die Sondergerichte wurden aus Personen von hohen Qualifikationen zusammengesetzt, die sich bemühten, alle Angaben zum Beschuldigten auf vertrauenswürdigen, bestgeprüften Informationsquellen zu stützen. Die danach veröffentlichten Urteile fanden die Anerkennung der Öffentlichkeit, da sie bewiesen, dass das Recht und die bürgerliche Moral weiterhin bestehen und bindend bleiben, und dass der Polnische Untergrundstaat seine Pflichten auch im Bereich der Justiz wahrnimmt.
