Abstract

"The Charter of Fundamental Rights of the European Union was signed and solemnly proclaimed in Nice in December 2000. A large ąuestion accompanied its inception, namely: what would be the status of this Charter? That ąuestion may be broken down into numerous inter-related ąuestions, including, inter alia, what were the reasons for drafting this Charter; would the Charter be referred to, or incorporated in, the Treaty; would its provisions be legally binding; what would be the scope of its provisions; how would consistency of interpretation of political and civil rights between the European Court of Justice and the European Court of Humań Rights be ensured?"(...)
