Wolność zgromadzeń w systemach prawnych Niemiec i Austrii

Abstract

Wolność zgromadzeń jest gwarantowana przez systemy prawne wszystkich demokratycznych państw oraz przez regulacje międzynarodowe. Należy do podstawowych wolności jednostki w państwie. Głównym celem tej wolności jest zapewnienie swobody wyrażania opinii i przekonań. Artykuł poświęcony jest analizie regulacji prawnych dotyczących wolności zgromadzeń w systemach prawnych wybranych państw (Niemcy; Austria). Jego celem jest pokazanie najważniejszych konstrukcji prawnych dotyczących wolności zgromadzeń, zwłaszcza form reglamentacji administracyjnoprawnej tej wolności.

Freedom of assembly is guaranteed by all legal systems of democratic states and by international regulations. It belongs to the fundamental rights of the individual in a given state. Th e aim of such freedom is to ensure freedom to express opinions and convictions. Th is article is devoted to the analysis of legal regulations concerning freedom of assembly in legal systems of the selected states (Germany; Austria). Its aim is to present the most signifi cant legal constructs concerning freedom of assembly, particularly various forms of regulation and administrative control of this freedom.
