Emocje w teorii prawa

Abstract

Pomimo wielu punktów stycznych pomiędzy emocjami a prawem emocje w kontekście zagadnień prawnych rzadko stają się przedmiotem badań, a zwłaszcza badań w teorii prawa. Na początku XX wieku Leon Petrażycki podjął jedną z pierwszych prób ustalenia zależności pomiędzy prawem a emocjami. Psychologiczna teoria prawa Petrażyckiego została oparta na koncepcji emocji etycznych. W tym ujęciu przyciągające i odpychające emocje etyczne wraz wyobrażeniami określonych zachowań stanowią podstawę motywów postępowania. Ówcześnie nowatorską teorię prawa Petrażyckiego, w świetle rozwoju psychologii, obecnie uznamy za nieaktualną i przestarzałą, w szczególności w zakresie rozumienia jej kluczowego elementu – emocji. Celem niniejszego tekstu jest rozważenie, jak obecnie możemy interpretować emocje w ramach psychologicznej teorii prawa. W tym celu proponowane jest skoncentrowanie się na analizie podejścia wywodzącego się z tzw. motywacyjnej tradycji badań nad emocjami – teorii konstruowanej emocji (L.F. Barrett). Podstawowym założeniem tej teorii jest to, że emocje nie są wyzwalane, lecz są konstruowane przez mózg na podstawie doświadczeń wywołanych przede wszystkim interakcjami ze środowiskiem, w którym funkcjonujemy. Zastosowanie teorii konstruowanej emocji pozwala na zaktualizowanie – na podstawie współczesnej wiedzy naukowej – psychologicznej teorii prawa.

Despite the many intersections between emotions and law, the study of emotions in the context of legal issues is much neglected, especially in legal theory. The first attempt to embrace all aspects of the correlations between law and emotions was made at the beginning of the 20th century by Leon Petrażycki. Petrażycki’s theory of law is based on concept of legal emotions. In this approach, emotions are understood as motives of behaviour, containing within itself an representation of a certain conduct and an appulsive ethical emotion or a repulsive one. In the light of development of psychology on which Petrażycki’s innovative theory of law is based, it has become outdated, especially in the context of understanding its key element – emotions. The goal of this study is to consider how emotions in the framework of the specifi ed theory of law should be comprehended presently. The author suggests to focus on analysing of the concept originated from the so-called motivational tradition of emotion studies – the theory of constructed emotion (L.F. Barrett). The fundamental assumption of this theory is that the emotions are not triggered, but are constructed by the brain based on experiences primarily induced by the environment. The application of the constructed theory of emotions in legal theory context can lead to developing an updated – based on modern scientific knowledge – psychological theory of law.
