Ustalanie tożsamości stron w świetle obowiązujących na ziemiach Królestwa Polskiego w XIX wieku przepisów notarialnych i hipotecznych a praktyka

Abstrakt
Ustalanie tożsamości osób biorących udział w czynnościach notarialnych w czasach Księstwa Warszawskiego i Królestwa Polskiego regulowały przepisy francuskiej ustawy notarialnej z 1803 r., a od roku 1876 przepisy rosyjskie notarialne z 14/26 IV 1866 r. oraz nieliczne przepisy niższego rzędu. Tożsamość strony opisywana była na podstawie jej: imienia, nazwiska, wykonywanego zawodu bądź rzemiosła, miejsca zamieszkania oraz zdolności do czynności prawnych. Przepisy francuskie wskazywały dwa sposoby poświadczania tożsamości strony: albo na podstawie osobistej znajomości przez notariusza, albo w przeciwnym przypadku potwierdzenie tożsamości przez dwóch rekognoscentów. Rosyjska ustawa notarialna z 1866 r., oprócz znanych z ustawy francuskiej sposobów, wprowadzała trzeci - poświadczenie tożsamości strony za pomocą legitymacji urzędowej. W przypadku niemożności ustalenia tożsamości strony w inny sposób (osobista znajomość czy świadectwo rekognoscentów) dopuszczone było stwierdzenie tożsamości za pomocą np. paszportu czy innego dokumentu urzędowego. Sposób ustalenia tożsamości stron wskazywały również inne przepisy - ustawa hipoteczna z 1818 r. i instrukcja hipoteczna z 1819 r., choć nie różniły się one od przewidzianych przez ustawę notarialną francuską z 1803 r. Dopiero od roku 1888 pojawiła się możliwość poświadczania tożsamości osób w postępowaniu hipotecznym za pomocą znanych z rosyjskiej ustawy notarialnej, legitymacji urzędowych. W Wydziale Hipotecznym Sądu Pokoju w Brzezinach tożsamość osób ustalana była przez pisarza w oparciu o przepisy prawa hipotecznego bez posiłkowego stosowania przepisów notarialnych. Najczęściej poświadczenie tożsamości opierało się na osobistej znajomości przez pisarza uczestnika czynności hipotecznych. Ustalanie tożsamości stron przez notariusza przyjmującego akty dobrej woli zawsze przebiegało według przepisów notarialnych niezależnie od tego, czy odbywało się w kancelarii hipotecznej czy poza nią.
Ascertainment of the identity of people participating in notary actions in the days of the Duchy of Warsaw and the Kingdom of Poland was regulated by the provisions of the French notary act of 1803, and beginning with 1876 - with Russian notary regulations of 14th/26th April 1866 and the few bylaws. The identity of the party was described on the grounds of their first name, last name, the occupation or craft performed, place of residence, and the ability to participate in legal proceedings. The French regulations pointed to two ways of corroborating the identity of the party: either on the grounds of the personal knowledge of the notary or else corroboration of identity by two people recognising the person. The Russian notary act of 1866 introduced the third way, besides the two known from the French act, namely establishing the identity on the grounds of an official identification document. In case of inability to ascertain the identity of a party in another way (familiarity or testimony of the people recognising the person), identity could be corroborated through a document, for example, a passport, or another official document. The manner of establishing the identity of the parties was also mentioned in other regulations, the mortgage act of 1818, and the mortgage instruction of 1819, even though they did not differ from the stipulations of the French notary act of 1803. It was, however, only since 1818 that the option to corroborate the identity of participants in mortgage procedures with official identity documents, known from Russian notary act, became possible. In the Mortgage Department of the Court of Peace in Brzeziny, the identity of people was ascertained by the scribe on the grounds of the stipulations of mortgage law without the support of notary regulations. In most cases, corroboration of identity was based on the familiarity of the scribe with the participant in mortgage proceedings. The corroboration of identity of the parties by the notary receiving the acts of good will always followed the notary provisions, whether it was held in the mortgage office or outside it.
Die Feststellung der Identität der an notariellen Handlungen teilnehmenden Personen in der Zeit des Herzogtums Warschau und des Königreichs Polen wurde mit den Bestimmungen des französischen Notariatsgesetzes von 1803 und nach 1876 mit den russischen Vorschriften über das Notariat vom 14-26.04.1966 sowie von einzelnen Vorschriften niedrigeren Ranges geregelt. Die Identität der Partei wurde anhand ihres Vor- und Nachnamens, des ausgeübten Berufes oder Gewerbes, ihres Wohnsitzes und ihrer Geschäftsfähigkeit festgestellt. Die französischen Vorschriften gaben in dieser Hinsicht zwei Möglichkeiten: die persönliche Bekanntschaft durch den Notar oder die Identitätsbestätigung durch zwei Zeugen (Rekognoszenten). Das russische Notariatsgesetz von 1866 führte, neben den im französischen Gesetz bekannten Methoden, auch eine dritte ein: die Identitätsfeststellung anhand eines amtlichen Ausweises. Sollte die Identitätsfeststellung auf andere Weise (also durch die persönliche Bekanntschaft oder durch die Rekognoszenten) nicht möglich sein, konnte die Identität der Partei anhand eines Reisepasses oder eines anderen amtlichen Ausweises festgestellt werden. Die Identitätsfeststellung wurde auch mit anderen Rechtsvorschriften geregelt - mit dem Hypothekengesetz von 1818 sowie mit der Anweisung zur Hypothek von 1819, auch wenn die Feststellungsformen von den des französischen Notariatsgesetzes von 1803 nicht unterschiedlich waren. Erst seit 1888 wurde die Möglichkeit eingeführt, die Identität im Hypothekenverfahren anhand der dem russischen Notariatsgesetz bekannten amtlichen Ausweise festzustellen. In der Hypothekenkammer des Friedensgerichts in Brzeziny wurde die Identität der Parteien von dem Schriftführer gemäß den Bestimmungen des Hypothekenrechts festgestellt, ohne unterstützende Anwendung der Vorschriften zum Notariat. In den meisten Fällen basierte die Identitätsfeststellung auf der persönlichen Bekanntschaft des Schriftführers mit dem Teilnehmer der Handlungen. Die Identitätsfeststellung der Parteien durch einen Willenserklärungen entgegennehmenden Notars, verlief dabei immer nach den Bestimmungen über das Notariat, unabhängig davon, ob diese in der Hypothekenkammer oder auch woanders stattfanden.
